Dillman & Owen Estate and Elder Law is a growing and dynamic law firm dedicated to serving the legal, financial, and care needs of aging individuals and their families. We specialize in elder law, estate planning, guardianship, probate, real estate and litigation. Our firm is seeking a motivated Litigation Associate with 3+ years of experience who is eager to further develop their litigation skills while working on contested guardianship, probate, and related litigation matters.
ABOUT THE ROLE
The Litigation Associate Attorney will represent clients in contested guardianship, probate, and related litigation matters while managing cases from initial strategy through resolution. This role requires strong legal writing, research, oral advocacy, critical thinking, and case management skills, along with the ability to exercise sound judgment and effectively manage multiple active matters and deadlines. The ideal candidate is proactive, intellectually curious, and passionate about advocacy and client service. This attorney will communicate regularly with clients, court personnel, opposing counsel, attorneys, and support staff while handling pleadings, motions, discovery, depositions, mediations, hearings, and trial preparation. The position offers meaningful hands-on litigation experience, opportunities for professional growth and mentorship, and the ability to work collaboratively within a supportive, team-oriented firm culture.
POSITION RESPONSIBILITIES
Litigation & Client Advocacy
- Represent clients in contested guardianship, probate, fiduciary, and related litigation matters
- Counsel clients regarding legal strategy, case developments, risks, and potential outcomes
- Advocate for clients during hearings, mediations, depositions, settlement negotiations, and court proceedings
- Build trusted client relationships through responsive communication, professionalism, and sound judgment
Legal Writing, Research & Strategy
- Draft pleadings, motions, briefs, discovery requests, and related litigation documents with accuracy and attention to detail
- Conduct legal research and apply relevant law to active matters
- Analyze facts, legal issues, and procedural considerations to develop effective case strategies
- Assist with deposition preparation, witness preparation, trial preparation, and litigation strategy development
Matter Management & Client Service
- Manage an active caseload while balancing deadlines, court requirements, and client expectations
- Maintain timely communication with clients regarding case status and next steps
- Ensure compliance with court rules, filing deadlines, and procedural requirements
- Utilize legal technology and emerging AI tools where legally and ethically appropriate to support efficiency and client service
Team Collaboration & Professional Development
- Work collaboratively with attorneys, paralegals, legal assistants, and administrative professionals to provide exceptional client service
- Participate in mentoring, training, and professional development opportunities
- Contribute to process improvement initiatives and the thoughtful integration of technology
- Participate in educational seminars, community outreach, and firm development efforts
QUALIFICATIONS & SKILLS
- 3+ years of litigation experience required (contested guardianship, probate experience preferred but not required)
- Strong legal writing, analytical, research, and oral advocacy skills
- Ability to manage a high volume of clients, cases and deadlines effectively
- Excellent judgment, critical thinking, and problem-solving skills
- Professional demeanor and commitment to high-quality client service
- Strong organizational skills and attention to detai
- Collaborative mindset and team-oriented approach to practice
- Ability to delegate and manage administrative staff effectively.
- Proficiency with Microsoft Office, legal research platforms, and practice management systems
EDUCATION & LICENSING
- Juris Doctor (JD) degree from an accredited law school.
- Licensed to practice law in Indiana (or ability to obtain reciprocity if licensed in another state).
